Tragic Worker’s Death at The Castle
August 08, 2017
A roofing company recently was fined after the death of one of their workers at The Castle, an upscale dining hall that’s being built to resemble an actual castle. The tragic accident occurred in November as the roof was being put on the building. The worker had been standing on a forklift in an improper manner to try to reach a ladder above him when a mechanical failure took place where the tines of the forklift that were holding him up detached from the rest of the forklift. This caused the young worker to fall from a height that’s estimated to have been between 20 and 40 feet. In this instance, the roofing company was fined $2,800 for their violations in another work-related case that included an employee falling. However, for the death of their worker, they were fined a heavy $38,025 and could probably be seeing a civil wrongful death lawsuit open up in the near future from family members of the 21-year-old that passed away. These are not the first brushes with OSHA that this company has experienced while they have been in business. They have a history of violations on file and have had to pay fines previously for unsafe working conditions for their employees. The most important thing you can do when you have suffered a workplace injury is to get in touch with a personal injury lawyer to speak about your injury and how it happened. An experienced worker’s compensation lawyer will then be able to tell you whether you have grounds to make a workplace accident compensation claim, and what steps you’ll need to take to move forward. Contact Garber Law, P.C. to go over your case details. They are ready to defend you while trying to seek the worker’s compensation benefits you deserve.
